A University of Miami student who prosecutors say had a blood alcohol level nearly triple the legal limit was slapped Monday with a DUI manslaughter charge for the fatal wreck that claimed the life of a grandmother.
Ivanna Victoria Villanueva, 19, was formally charged Monday in Miami-Dade Circuit Court.
Coral Gables police say that on Oct. 3, Villanueva plowed her 2011 Audio Q5 into a Ford Focus driven by Eyder Ayala, 68, at the intersection of LeJeune Road and Majorca Avenue just after 4:30 a.m.
The crash immediately killed Ayala, a mother of five and grandmother of seven. She was a longtime manager at a local McDonald’s.
Coral Gables police at first, charged Villanueva with vehicular homicide.
On Monday, prosecutors added the DUI manslaughter charge — which carries a 15-year maximum prison sentence — as well as a third-degree felony count of possessing a false drivers license. Prosecutors earlier said that Villanueva had several fake IDs which she used to get into the swank LIV nightclub in Miami Beach.
A toxicology report released by the prosecutors shows that shortly after the crash, her blood alcohol level was .231. The legal limit is .08.
Villanueva, a UM sophomore, played varsity lacrosse and soccer at Palmer Trinity High. She has pleaded not guilty and is under house arrest pending trial.
“This is a tragic case all around, and the Villanueva family would like to extend their deepest sympathies to the Ayala family,” said David O. Markus, her attorney.
The Ayala family is also suing Villanueva and her father, who owns the Audi, for negligence.
